§1 Identification

These Terms and Conditions define the rules and procedures for concluding distance sales agreements in the Store between the Seller and the Customer/Consumer.

§2 Definitions

Consumer – a natural person concluding an agreement with the Seller via the Store, whose subject matter is not directly related to their business or professional activity.
Seller – a natural person running a business under the name Jakub Karoń.

Customer – any entity making purchases through the Store.

Entrepreneur – a natural person, legal entity, or organizational unit without legal personality, granted legal capacity by a separate act, conducting business and using the Store.

Store – the online store operated by the Seller at hatepark.store.

Distance contract – an agreement concluded with the Customer within an organized system for concluding distance contracts, without the simultaneous physical presence of the parties, using means of remote communication until the contract is concluded. Consumers have the right to withdraw within 14 days without giving a reason.

Terms and Conditions – these Terms and Conditions of the Store.

Order – the Customer’s declaration of intent made via the Order Form, aimed at concluding a Sales Agreement for a
Product or Products with the Seller.

Account – a customer account in the Store where data provided by the Customer and information about placed orders are stored.

Registration form – a form available in the Store allowing the optional creation of an Account.
Order form – an interactive form available in the Store enabling the placement of an Order, including adding Products to the Cart and specifying the terms of the agreement, delivery, and payment method.

Cart – a feature of the Store software showing selected Products for purchase and allowing the modification of the order, including product quantities.

Product – a movable item or service available in the Store that is the subject of the Sales Agreement.

Sales Agreement – a contract for the sale of a Product concluded or to be concluded between the Customer and the Seller via the Store.

§3 Type and scope of services
The Store offers the sale of used clothing as well as new clothes with tags, and accessories. 

§4 Order placement rules
To place an order, the Customer must:
a) Optionally create an Account and log in to the Store.
b) Add the chosen Product to the Cart, proceed to checkout, and complete the order.
c) Choose the delivery country, payment method, delivery type, and fill in the recipient’s details.
d) It is possible to issue an invoice and add order comments.
e) Accept the Terms and Conditions and click “Order and Pay”.
f) The order processing time is counted from the moment a positive payment authorization is obtained.

§5 Delivery, payment methods, and prices
Delivery options:

Courier (Inpost, DHL, DPD)

Pickup point (Inpost, DHL, DPD, Orlen Paczka)

Deliveries are made within the European Union and the United Kingdom.

Other payment methods available in the Store

The entity providing online payment services for card transactions is Autopay S.A.

Prices:
Displayed in PLN or EUR
Do not include VAT, as the Seller is not obliged to pay it.
Refunds:
In case of a refund for a transaction made by credit/debit card, the Seller will refund the funds to the bank account associated with the Customer’s card.

§6 Right of withdrawal
Consumers have the right to withdraw from the contract within 14 days of receiving the Product.

The Customer bears the cost of return shipping.

The customer must return the product in an undamaged condition within 14 days from submitting the declaration of withdrawal.

In the event that a refund for a transaction made by the customer with a payment card is required, the seller shall refund the amount to the bank account linked to the customer’s payment card.

§7 Complaints

§8 Seller liability

The Seller is responsible for the conformity of Products with the contract in accordance with applicable law.

The seller is not responsible for lost parcels. Responsibility lies with the courier company chosen by the Buyer.

§9 Personal data processing (GDPR)

When placing an order, the Customer may consent to the processing of personal data for the purposes of order fulfillment, shipping, returns, and complaints.
Data is processed in accordance with applicable data protection regulations.

§10 Buyer’s Responsibility

The buyer confirms that they have read the product description, including the measurements and the way they are taken, and accepts the provided information.

A product marked as "vintage" does not have its flaws described in detail. The flaws are present because these items were manufactured around the 2000s. The flaws are visible in the photos. The buyer is obliged to carefully examine them and make a considered purchase.


§11 Final provisions
The Seller will notify Customers of any changes to the Terms and Conditions.
In matters not regulated in these Terms and Conditions, generally applicable Polish law applies.
The Seller undertakes to comply with Polish law.
